(Minghui.org) Mr. Jin Xiaofeng’s family finally got an appeals court to accept a motion to reconsider his case. His human rights, however, are still being violated while he is serving a three-year term for his faith in Falun Gong. His pension has been suspended, he is only allowed 10 minutes for family visits (instead of the typical 30 minutes), and he has to do hard labor for almost 12 hours a day every day.
Motion Accepted, Returned, and Accepted Again
Mr. Jin, 65, of Shenyang City, Liaoning Province, was arrested on July 13, 2024, and sentenced to three years on March 31, 2025. After the Shenyang City Intermediate Court rejected his appeal on May 28, 2025, he was admitted to the Shenyang City First Prison on July 28.
The Shenyang City Human Resources and Social Security Bureau stopped Mr. Jin’s pension after he was sentenced and ordered him to return the retirement benefits issued to him between his arrest and transfer to prison. His former employer, Shenyang University, also canceled the retirement benefits he was entitled to.
While seeking to have his pension reinstated, Mr. Jin’s family is also working hard to have his wrongful conviction overturned. From July to September 2025, they tried nearly ten times to submit a motion to reconsider his case, but the Shenyang City Intermediate Court always refused to accept it. They finally got hold of Wei Zengkui, a vice president of the first criminal division within the intermediate court, and he instructed the receptionist to accept the motion.
A week later, however, the motion was returned to Mr. Jin’s family. They contacted Han Zhitong, the president of the second criminal division within the intermediate court, and he replied that he needed to find out who Jin Xiaofeng was and what the case was about. He never got back to them or responded to their repeated phone calls.
The family then found judge Han Yuchuan’s number in a case document and called him. He claimed that he was not involved in the case and that his colleagues likely put his name there by mistake.
After the family filed a complaint with the discipline division of the intermediate court, they were told that a judge would reach out in three days. No one ever contacted them, and court president Wang Zhiwen never answered their phone calls.
The family went to the intermediate court again in December 2025 to resubmit their motion and demanded to know why it was returned in the first place. The receptionist declined to accept the motion because “resubmission was not allowed.” The family said that the court never gave them any explanation for why it was returned. The receptionist then claimed that she had no clue what was going on and referred them to the second criminal division. The family said that no one had ever responded to them and that she must accept the motion or have a court official come out to talk to them.
The receptionist consulted Han, and he instructed her to accept the motion.
Mr. Jin’s family filed a complaint with a higher agency, asking that the intermediate court be held responsible for violating the law by repeatedly refusing to accept their motion to reconsider the case.
Rights Violated in Prison
After Mr. Jin was admitted to prison, he was first held in Division 14 (which is for newly admitted inmates) before being assigned to Division 15 on August 8, 2025. He was later moved to Division One. When a team leader in Division One ordered him to renounce Falun Gong, he told him that he broke no law by exercising his constitutional right to freedom of belief. Every time he was allowed to see his family, he reminded them to seek justice for him.
From July to November 2025, Mr. Jin was only allowed 20-minute meetings with his family on visitation days. His family asked to extend the meeting time to the typical 30 minutes the other inmates were allowed but was told that newly admitted inmates on probation were only allowed 20-minute meetings according to a Liaoning Province Prison Administration Bureau policy.
The prison also said that, in January 2026, they’d evaluate Mr. Jin to see if he could be promoted from probation-inmate to regular-inmate and be eligible for 30-minute family visits. His family learned later that a prerequisite for the “promotion” was that the inmate must admit his guilt.
Mr. Jin didn’t commit any crime, so his family called the Liaoning Province Prison Administration Bureau to file a complaint against the prison. The bureau’s receptionist, however, demanded that the family admit Mr. Jin was guilty before she could record their complaint. The family protested as no law required them to do that. The receptionist eventually logged the complaint.
The next day, however, the family learned that Mr. Jin had been put on “strict management” for holding firm to his faith. His family visits were then shortened to just ten minutes, and he was not allowed to spend more than 150 yuan a month on daily necessities.
The family went to the prison to protest the strict management, but to no avail.
Mr. Jin now has to do hard labor from 7 a.m. to 6:30 p.m. every day.
